Definitions
Lessor: Toer Eend Friesland (ToerEend), owner of the rented classic car(s).
Renter: the natural person or legal entity entering into the rental agreement.
Vehicle: the rented Citroën 2CV or other classic car.

Applicability
These terms apply to all rental agreements between lessor and renter, unless agreed otherwise in writing.

Rental period
The rental period is set out in the rental agreement. The renter is obliged to return the vehicle on the agreed date and time.

Driver's licence and drivers
- The renter is at least 24 years old and holds a valid category B driving licence that has been valid for at least two years.
- Drivers under 24 or over 75 are excluded, unless otherwise agreed in writing.

Payment, deposit and payment terms
- The full rental sum is paid in advance (bank transfer or agreed method).
- At pick-up, a copy of the main driver's licence is made and a rental agreement is signed.
- The vehicle is only handed over once full payment has been received and a copy of the driver's licence and signed rental agreement have been provided.
- If payment is not received (on time), the agreement may be cancelled.

Inspection at pick-up and return
A joint inspection takes place at pick-up and return; findings are recorded and signed by both parties.

Use of the vehicle
- Recreational private use within the Netherlands only, unless otherwise agreed in writing.
- Forbidden without permission: driving lessons, competitions, off-road, transporting hazardous materials, commercial purposes.
- Transfer to third parties only with the lessor's permission.
- Personal luggage racks, roof boxes or other additions to the vehicle are not permitted without prior written permission from the lessor.
- The lessor is at all times entitled to reclaim the vehicle in case of suspected misuse or breach of these terms, without right to a refund of the rental fee.

Maintenance on longer trips
The Citroën 2CV is a vehicle of more than 35 years old with technology of almost 50 years old. Driving and braking characteristics may differ from what you are used to. For trips longer than 2 hours at a stretch, the renter is required to check oil level, brake fluid level and tyre pressure at every fuel stop and top up where necessary. The lessor is not liable for damage resulting from failure to carry out this check during the trip.

Use abroad
Use outside the Netherlands only with prior written permission.

Parking and security
- Always park safely and responsibly, preferably in paved/secured locations.
- Unpaved or unsafe locations are not permitted.
- Always lock the vehicle; keep keys carefully.

Insurance and liability
- The vehicle has third-party liability insurance; additional insurance is possible under the applicable terms.
- Comprehensive (All Risk) insurance is not included. The renter is fully liable for any damage to the vehicle, unless otherwise agreed in writing.
- The renter is liable for damage caused by their own fault, negligence or improper use, as well as theft/loss of the vehicle or keys.
- The excess per damage case is € 500. This amount is always payable by the renter, unless otherwise agreed.

Mileage allowance and fuel
- Includes 150 km per day; additional kilometres are charged at € 0.20 per kilometre.
- Full-to-full policy: the car is collected with a full tank and returned with a full tank (otherwise fuel costs will be charged).

Damage, defects, breakdown and repairs
- Report damage/defects immediately.
- In case of breakdown: contact the lessor immediately; no own repairs without written permission.
- The lessor is not liable for consequential damage due to breakdown or defects.
- Maintenance/repairs are the lessor's responsibility, unless caused by negligence or misuse by the renter.

Cancellation, changes and no-show
- More than 30 days before the start: free cancellation or rescheduling.
- 14 to 30 days before the start: 25% of the rental fee is retained.
- 2 to 14 days before the start: 50% of the rental fee is retained.
- Within 48 hours before the start or in case of no-show: 100% of the rental fee is retained.
- In case of illness with a doctor's note or KNMI weather code orange/red, a credit valid for 12 months may be issued instead of a refund.
- Refunds are processed within 14 days to the same account the payment came from.
- Changes (date, vehicle) are possible in consultation and subject to availability.

Conduct and rules of use
- Smoking in the vehicle is forbidden.
- Pets are only allowed with written permission.
- Return the car clean and without new damage.
- Driving under the influence of alcohol/drugs is forbidden and leads to immediate termination without refund; all costs are payable by the renter.

Traffic and parking fines and administration costs
All fines received during the rental period are passed on to the renter, plus 10% administration costs.

Multiple renters
If the rental agreement is signed by more than one renter, all renters are jointly and severally liable for the full performance of the obligations under this agreement.

Privacy and data processing
Personal data is processed exclusively for the performance of the agreement and in accordance with the GDPR. Sharing with third parties only when necessary or legally required.

Force majeure
The lessor is not liable for non-performance due to force majeure (including technical issues, weather conditions or other unforeseen circumstances).

Changes to the terms
The lessor may amend the terms. Changes take effect 14 days after written notice, unless otherwise agreed.

Maximum driver age
Drivers may not be older than 75 years, unless otherwise agreed in writing.

Maximum driving time (recommendation)
Preferably do not drive for more than 6 hours continuously to prevent overheating/wear. Prolonged intensive use is at the renter's risk.

Use for commercial purposes
Commercial use (paid trips, advertising, events) is forbidden without written permission.

Passenger limit
No more occupants than the number of approved seats listed in the vehicle documents.

Keys and key loss
The renter keeps the keys carefully. In case of loss/theft, replacement costs (including locks if necessary) are payable by the renter.

Extra cleaning costs
The vehicle is provided clean and must be returned clean. In case of heavy soiling, smoke smell or pets without permission, additional cleaning costs of at least € 25 will be charged.

Accessories and belongings
Modifications/accessories may only be added with written permission. Belongings left behind remain at the renter's risk.

Indemnification
The renter fully indemnifies the lessor against all third-party claims related to use of the vehicle during the rental period.
The lessor is not liable for consequential damages such as costs from delays, missed appointments or other indirect damages arising from the use, defect or breakdown of the vehicle.

BOVAG fallback clause
Where these terms are insufficient or inadequate, the BOVAG standard provisions for car rental, or Dutch law, shall apply.

Applicable law and disputes
Dutch law applies. Disputes will be submitted exclusively to the competent court in the lessor's district.
